Copyright & Intellectual Property Policy

1. Platform Ownership

1.1 Ownership of the Platform

All platform elements—including text, design, layout, graphics, logos, icons, interface components, algorithms, software code, databases, and overall structure—are the exclusive property of Art Unlock Inc.

These materials are protected under:

• U.S. Copyright Act
• U.S. Digital Millennium Copyright Act (DMCA)
• International copyright treaties
• U.S. trademark and trade dress laws

1.2 Restrictions

Users may not:

• Copy, reproduce, modify, distribute, or create derivative works of the Platform
• Reverse-engineer or extract any part of the software
• Use Art Unlock branding without prior written authorization

Unauthorized use is strictly prohibited and may result in account termination and legal action.

2. User-Generated Content

2.1 Ownership of User Content

Users and Artists retain full copyright and moral rights to the artworks, images, text, videos, documentation, and materials they upload (“User Content”).

Art Unlock does not claim ownership over any User Content.

2.2 License Granted to Art Unlock

By uploading or posting content to the Platform, Users and Artists grant Art Unlock a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:

• Display content on the Art Unlock platform, search engine, and directory
• Use content for marketing, newsletters, and social media promotion
• Reproduce and distribute content in the Art Unlock Annual Guide (in both e-book and print-on-demand formats)
• Use content in promotional materials, exhibitions, or press releases related to Art Unlock

This license remains active for as long as the User’s account is active.

If a User deletes their account, the license ends—except for materials already printed, published, or distributed prior to deletion.

2.3 User Responsibility

Users affirm that:

• They own or control all rights to their submitted content
• The content does not infringe any third-party rights
• All uploaded materials comply with applicable laws

Users are solely responsible for the content they submit.

3. Copyright & Infringement Claims (DMCA-Aligned)

Art Unlock complies with the Digital Millennium Copyright Act (DMCA) and international copyright standards.

3.1 Submitting a Copyright Complaint

To report alleged infringement, send a notice to:

Your complaint must include:

• Identification of the copyrighted work claimed to have been infringed
• URL or exact location of the allegedly infringing material
• Proof of ownership (e.g., copyright registration, publication record, original files)
• A good-faith statement that the use is unauthorized
• A declaration made under penalty of perjury confirming accuracy
• Your full legal name, address, phone number, and email
• A physical or digital signature of the copyright owner or authorized agent

3.2 Response and Removal

Upon receiving a complete and valid notice, Art Unlock will:

• Review the claim
• Remove or disable access to the infringing content
• Notify the User responsible for the content

Art Unlock may request additional information if needed to validate the claim.

3.3 Counter-Notification (If Applicable)

If a User believes that removed content was taken down in error, they may submit a counter-notice containing:

• Identification of removed content
• A statement under penalty of perjury that the removal was a mistake
• Consent to jurisdiction of federal courts in the United States
• Contact information
• Digital or physical signature

Upon receipt, Art Unlock may restore the content unless the complainant initiates legal action.

5. Additional Provisions

5.1 No Monitoring Obligation

Art Unlock does not pre-screen User Content and is not obligated to monitor all uploads. However, we reserve the right to remove or disable content at our discretion.

5.2 Preservation of Moral Rights

Nothing in this Policy diminishes an Artist’s moral rights, including attribution and integrity of their artwork, where applicable by law.

5.3 Cooperation with Authorities

Art Unlock may cooperate with law enforcement in investigations involving copyright fraud or unauthorized use.
