This Artist Participation Agreement (“Agreement”) governs the participation of artists on the Art Unlock Platform and in any associated programs, listings, studio visits, events, or the Art Unlock International Open Studios Festival (“Festival”).
By registering as an Artist on the Platform, you acknowledge and agree to the terms below.
1. Eligibility & Registration Requirements
1.1 Eligibility
To participate as an Artist, you must:
- Be at least 18 years old
- Own or have legal rights to present the artworks displayed
- Have lawful access to the studio or space listed
- Provide accurate and truthful professional information
Art Unlock may request verification of identity or eligibility at any time.
2. Artist Responsibilities
Artists agree to:
2.1 Provide Accurate Information
You must maintain precise, current, and truthful information regarding:
- Studio address and access instructions
- Opening hours, visit availability, and scheduling
- Safety considerations (stairs, pets, restricted areas, hazards)
- Artwork titles, descriptions, and images
- Biography, links, and professional details
2.2 Maintain Studio Safety
You are solely responsible for ensuring your studio or venue:
- Complies with local safety, zoning, and occupancy regulations
- Is reasonably safe for visitors
- Includes appropriate signage, lighting, and hazard warnings
- Is insured where required (recommended: general liability insurance)
Art Unlock does not inspect or monitor physical spaces.
2.3 Visitor Interaction
Artists agree to:
- Treat visitors respectfully
- Provide clear studio access instructions
- Communicate promptly regarding scheduling changes
- Ensure minors (if any) are accompanied by guardians
- Prevent unsafe behavior within the space
3. Content & Intellectual Property
3.1 Ownership
Artists retain all copyright ownership over their artworks, images, and written content.
3.2 License to Art Unlock
By uploading content, you grant Art Unlock a non-exclusive, worldwide, royalty-free license to:
- Display your profile on the Platform
- Promote your participation in events or festivals
- Feature artworks in digital guides, newsletters, and marketing
- Use your studio images for event listings
You may revoke this license by deleting your content or terminating your account.
3.3 Artist Responsibility for Rights
You represent that:
- You own the rights to all uploaded materials
- No content infringes third-party intellectual property
- You have necessary permissions for any collaborative works or images
4. Liability & Risk Acknowledgment
4.1 Artist Assumption of Risk
Artists acknowledge that:
- Studio visits involve inherent risks (crowds, foot traffic, fragile works, etc.)
- Visitors may accidentally damage property or artworks
- Art Unlock does not provide insurance coverage
4.2 No Liability for Art Unlock
Art Unlock is not responsible for:
- Injuries, accidents, or property damage occurring in the Artist’s studio
- Theft, vandalism, or loss of artwork or materials
- Misconduct of visitors or third parties
- Accuracy of user profiles or behavior of attendees
- Cancellations, no-shows, or scheduling conflicts
Artists participate at their own risk.
4.3 Indemnification
Artists agree to indemnify and hold harmless Art Unlock from any claims, damages, or liabilities arising from:
- Studio conditions
- Visitor interactions
- Artwork legality
- Copyright violations
- Misrepresentation or false information
5. Event Participation (Festival or Public Programs)
5.1 Requirements
Artists participating in the Open Studios Festival or related events agree to:
- Follow the event schedule and guidelines
- Welcome registered attendees during published visiting hours
- Maintain a clean, safe, respectful environment
- Avoid last-minute cancellations unless due to emergency
- Display only works they have rights to present
5.2 Media & Documentation
Art Unlock may photograph, record, or document Festival events. Artists consent to reasonable use of:
- Studio views
- Installation images
- Event photographs
- Public interactions
Use is limited to the promotion of Art Unlock programs.
5.3 Press Access
If press visits are scheduled:
- Artists must provide access as arranged
- Personal spaces beyond the studio are not required to be shown
- Artists may request no photos of specific works
6. Payments, Plans & Upgrades
6.1 Plan Structure
Artists may enroll in:
- Free Plan (with limitations and no guarantee of visibility)
- Premium Plan (enhanced features, visibility, and support)
6.2 No Refund Policy
Payments for upgrades or premium plans are non-refundable, except where required by law.
6.3 Account Suspension
Art Unlock may suspend or terminate an Artist’s account for:
- Policy violations
- Safety concerns
- Repeated no-shows
- Inappropriate conduct
- Posting prohibited content
7. Prohibited Conduct
Artists may not:
- Endanger visitors
- Share false studio information
- Upload explicit, hateful, or illegal content
- Harass visitors or other artists
- Use Art Unlock for political propaganda
- Engage in fraud or misrepresentation
- Collect visitor data without permission
- Reproduce or misuse Art Unlock’s brand or design
Violations may result in immediate removal.
8. Termination
Artists may terminate their participation at any time. Upon termination:
- Profile and content will be removed
- Art Unlock may retain minimal data for legal compliance
- Licenses granted for promotional materials may continue for previously published works
9. Governing Law
This Agreement is governed by the laws of the State of New York. Disputes will follow the arbitration rules described in the Terms & Conditions.
